RE:     AB-542 Self-service storage facilities: lien sales. – Request for Signature

Dear Governor Newsom,

On behalf of (company name), we respectfully request your signature on AB 542 by Assemblymember Juan Carrillo. This bill will modernize outdated newspaper advertising requirements by permitting California self storage owners to advertise upcoming lien sales on a publicly accessible website, provided that the sale is also advertised once in a newspaper of general circulation.

Currently, before a self storage lien sale may be conducted, operators must publish an advertisement twice in a newspaper of general circulation. However, this advertising requirement is outdated. Since the emergence of the internet and other electronic means of communication and information sharing, newspaper publication is not the only method of communication with the public. To this end, 32 states permit advertisements via another mechanism other than newspapers preceding the sale or have no advertising requirement at all. California is one of only a dozen states that still requires two newspaper advertisements before a sale.

Notably, AB 542 garnered unanimous support in the Legislature. This simple change in law will reduce an unnecessary burden on many small California storage owners while also expanding the access and visibility to lien sale advertisements.  For this reason, we respectfully request your signature on AB 542 (Carrillo).
